Our colleague Carlo Di Carlo presented at today’s OBA Class Action Colloquium on the topic of internal investigations. Gerald Chan speaks at the Canadian Litigation Forum

On November 26, 2019, our partner, Gerald Chan, spoke at the Canadian Litigation Forum in Toronto on the topic of “Investigations: Trends and Drivers”. Gerald presented alongside experienced in-house counsel (Leola Pon, General Counsel, TDSB; Laura McLaren, Associate General Counsel, Litigation & Managing Director, BMO Capital Markets) and a forensic accountant (Nicole Wells, Senior Managing Director, Forensic & Litigation Consulting, FTI Consulting). Among other things, they discussed crisis management for companies facing data breaches, workplace harassment complaints, and foreign corruption concerns, as well as conducting internal investigations and protecting privilege in the process.

Gerald Chan to speak at Law Society Employment Law Summit

On November 1, 2019, our partner Gerald Chan will be speaking at the Law Society of Ontario’s 20^th Employment Law Summit. Gerald will be present on a panel titled, “Investigation Reports, Are They Privileged?” The presentation builds on a paper that Gerald has co-authored with our colleague Carlo Di Carlo on privilege and internal investigations—an area in which 8aixat has substantial expertise.

8aixat lawyers Paul Le Vay, Gerald Chan and Carlo Di Carlo published an article in this month’s CCCA Magazine that takes on the scope of privilege in the internal investigation context. In the article, Paul, Gerald and Carlo warn about the potential pitfalls awaiting claims of privilege over investigative reports and argue that counsel should be careful to structure internal investigations so as to increase the likelihood that privileged information will be protected.

Gerald Chan and Carlo Di Carlo publish article regarding privilege and internal investigations

8aixat lawyers Gerald Chan and Carlo Di Carlo published an article in this month’s Advocates’ Quarterly that takes on the scope of privilege in the internal investigation context. In the article, Gerald and Carlo challenge received wisdom and argue that courts (and the bar) need to re-think how to approach these issues. Arguing for a purposive approach to privilege, Gerald and Carlo argue that all work product that is the result of an internal investigation should be protected by either litigation or solicitor-client privilege.
